What to gather before we calculate the actual return on your pre-cohabitation super.

The more of these we have, the tighter the valuation. Anything you cannot find — tell us; we will reconstruct what is reconstructable and disclose what is not.

Identifying the period

We need precise dates so we apply the right years of investment returns and contribution treatment.

  • Date cohabitation commenced

    Essential

    Move-in date for de facto relationships, or wedding date if you cohabited from then. A statutory declaration is acceptable where the date is in dispute.

  • Date of final separation

    Essential

    Or the agreed valuation date the parties are working to. Where separation is contested we will run two scenarios.

  • Member's date of birth

    Essential

    Used for preservation, contribution-cap and benchmark cohort matching.

Member statements

Annual statements are the single most valuable evidence — they fix the balance, the investment option and the fee basis at each year-end.

  • Annual statement closest to cohabitation date

    Essential

    Ideally the statement for the financial year in which cohabitation began, or the one immediately before.

  • Most recent annual statement (or statement at separation)

    Essential

    PDF download from member online is fine — we do not need a certified copy.

  • All annual statements in between

    Preferred

    Each year fills a gap; missing years are reconstructed from APRA fund data with a wider error band.

  • Half-yearly or quarterly statements

    Helpful

    Useful when cohabitation or separation falls mid-year.

Transaction & contribution history

Contributions during cohabitation are matrimonial; contributions before are not. We need to identify and remove them.

  • Member transaction history for the cohabitation period

    Downloadable from most fund member portals as a CSV or PDF. Shows employer SG, salary sacrifice, personal contributions, rollovers, insurance premiums and fees.

  • ATO MyGov 'Super' contributions report

    Essential

    Log in to my.gov.au → ATO → Super → Information. Export the year-by-year contributions and fund accounts list.

  • Notices of intent to claim a deduction (s.290-170)

    Preferred

    Where personal deductible contributions were made.

  • Rollover statements

    Preferred

    Where the member changed funds during the relationship.

Investment option evidence

The 'actual return' depends on which option the member was invested in. Defaults are not always correct.

    Date and direction of any option changes.

  • Insurance arrangement summary

    Helpful

    Lets us isolate insurance premium drag from investment performance.

Defined benefit & special funds

Skip this section for accumulation-only members. Required where the interest is in a defined benefit or hybrid scheme.

  • Most recent benefit statement showing service period and accrued multiple

    Essential

    PSS, CSS, MSBS, ESSSuper, GESB West State, QSuper Defined Benefit, judicial pensions, etc.

  • Family Law Information Form (Form 6) or equivalent fund response

    Essential

    Provides the statutory information the scheme actuary has already prepared.

  • Salary history during cohabitation

    Preferred

    Annual final-average salary figures or PAYG summaries.

Background documents

Useful context that occasionally affects how the report is framed.

  • Form 13 / Financial Statement (if filed)

If documents are missing

Most matters arrive with at least one gap. We can usually reconstruct the missing piece from ATO MyGov data, APRA fund-level returns, and contribution norms for the member's industry and age. The report will identify each substitution and show the resulting sensitivity range — so the court or mediator knows exactly how much weight to give the figure.

  • No statement at cohabitation? We benchmark from ATO income and APRA returns.
  • Fund closed or merged? We obtain successor-fund data on your behalf.
  • Investment option unknown? We use the default strategy and disclose it.
